There are many benefits of filing a copyright. Even though your work is automatically protected, there are four reasons why registration of copyrightable materials can be extremely advantageous:
- Creates a public record of your copyright claim which serves as an even stronger notice of your ownership claim to the entire world and not just those who see your work with the copyright notice attached.
- The ability to file suit to enforce copyright in federal court. You may file a copyright even if the infringement has already occurred.
- Evidence that your copyright is valid if filed within 5 years of publishing your work provides prima facie evidence of the validity of your copyright.
- If you file your registration of copyright within 3 months of publishing your work, or at any time prior to an infringement, your registration allows you to recover statutory damages and attorney’s fees. In some cases, statutory damages for infringement may entitle you to a pre-determined amount of damages (ranging from $750 to $30,000 for basic infringement, and up to $150,000 if it is willful). 17 U.S.C. § 504(c).
